An Introduction to Software Patents under UK Law <br /><br />As anyone working inside or alongside the profession well knows, British Law is a complex entity to get to grips with. One area in particular which often requires extra attention from legal analysts or advisors is that of Software Patents.<br /><br />In a vain similar to the protection rights of Intellectual Property (IP), it is often difficult to describe exactly what Software Patent is. Whilst there is no decisive legal definition, Software Patent can be defined as a patent that is in place to enhance a computers performance by means of an application which is installed into the computers system. It is intended to prevent others from using the same programming techniques without adequate rights or access. The Software Patents discussion is one which is ongoing and passionately debated.<br /><br />As it presently stands under UK Law, there are four over-arching requirements which must be in place for a patent to be legally acknowledged. First of all, there must be some proof of a new idea or invention being formulated. In addition to this, the new invention must be original, innovative, and compatible of industrial need and application. Patent Laws across the continent are consistent in that they all identify a rather extensive list of items which are considered as failing to meet these requirements. Software, of computer programming is indeed one of them. <br /><br />Confusion often arises then since the United Kingdom Intellectual Property Office (UKIPO) frequently allows software inventions to be considered for Patentability. For this reason, the topic of Software Patency is a matter which is debated by legal minds all around the world. In the UK specifically, Anthony Ram believes that loopholes seem to arise from the fact that although the UK Patent Act (1977) explicitly grants patents to inventions, the term invention can be loosely translated from one person to the net and is not out rightly defined anywhere within the Act.<br /><br />Patent Software Law is evidently a difficult matter to understand.
