We are current on the payments for now but can barely make the minimum each month. Even if I can keep up the payments I have decided that I don't want to. We are getting no where and figured it will take 30+ years to pay it off the way we are going. I have talked to a bankruptcy attorney and he said he wasn't sure if we would qualify for Chapter 7, he could file it and it may go to Chapter 13. I'm trying to decide what we need to do to get out of this and move on with our lives. I have talked to the consumer credit counseling and they said there was nothing they could do for us because our interest rates were already good and that is all they do is lower the interest rates. Their consolidated payment plan was more than we are paying now. We have a house that we moved out of and are renting to cover the mortgage that we are trying to sell. Any money we make on it has to pay back my mother that we owe $8300 and my work that I owe $2800 to. We are currently living in my grandmother’s garage apartment rent-free but it is a musty, moldy, drafty shack and I think it is making us sick. We have to get rid of this credit card debt so we can move on and afford a better place to live. Any suggestions are helpful. This is what I’m thinking about but bankruptcy is a one shot deal so I want to make the most of it and choose the right thing for us. br 1. I could just file in my name and leave my husbands credit so we can get an apartment or something but would still be left with his $10,000 in credit cards. br 2. We could both file and both have bankruptcy on our credit. br 3. I could try and get some of his $10,000 onto my credit with balance transfers and then wait 90 days to file. I’m afraid we wouldn’t qualify if he didn’t have any debt though.
