आजादी के बाद से संविधान के अनुच्छेद 19 (1) (A)में इंडियन्स को फ्रीडम ऑफ स्पीच का अधिकार दिया गया. जिसके मुताबिक भारत का कोई भी नागरिक लिखकर, बोलकर, छापकर, इशारे से या फिर किसी भी तरीके से अपने विचार व्यक्त कर सकता है. भारतीय संविधान में एक और भी क्लॉज जोड़ा गया जो कि अनुच्छेद 19 (2) है. जिसमें ये साफ किया गया है कि किन हालातों में बोलने की आजादी पर रोक लगाया जा सकता है.
