Don Lemon’s lawsuit against Elon Musk and X Corp. will proceed to trial, a San Francisco judge ruled this week, according to CNBC. The decision rejects Musk’s efforts to dismiss the case or move it to Texas. Attorneys representing Musk and X declined to comment on the case. Judge Harold Kahn found Lemon plausibly alleged “fraud by false promise” and an “implied contract” in his complaint. Lemon filed the suit in August 2024, shortly after X canceled its partnership with him hours after a tense interview with Musk. In the interview, Lemon challenged Musk on inflammatory posts, including claims of a “Hispanic invasion” and the “great replacement theory,” as well as X’s content moderation policies and rising antisemitism. The judge’s decision comes as Musk and X face other lawsuits over unpaid bills and severance.
