Find the best financial services for you at: SMARTFINANCESOLUTIONS.NET - Do they have a legal leg to stand on? - Yesterday, on the 12 th I received a letter from a debt relief agency/attorney saying that on the 9th(a few days earlier) a lawsuit had been filed against me in my local court district for an 8 year old private student loan by another company. The debt relief company claiming to want to help me said in the letter that they could help me fight the lawsuit, file bankruptcy, or sue the company trying to sue me. They said in most cases they never even have to go to court. I have not even been served yet by the company they said is sueing me, but the debt relief company said it is common to get their letter before getting served with a lawsuit by the other company. My first question is how can I be sued for an 8 year old unsecure private loan that is listed as closed and paid-charged off on my credit report? This loan is not even listed on the National Student Loan database with my other federal loans.It is also not even listed as in collections on my credit report and it also has a positive check next to it unlike my actual federal loans. Can a person be sued in court for an 8 year old private loan that says paid-charged off when it is not even listed on my report as being sent to any collections? Also, I was never given a debt validation by the company that claimed to even hold this private loan before charging it off and closing it out all together. Can your credit report read in good standing but then someone comes out of the blue to sue you for an 8 year old debt that is closed when the Statute of Limitations is four years? One more thing, how could the company claiming to want to help me find out on the 9th but have their letter sent to me by the 12th? Seems odd to me.Thank you.
